Kalio Studio, LLC, doing business as FitFights ("we," "us," or "our") operates the FitFights application and the website at fitfights.com. This Privacy Policy explains how we collect, use, and share your information when you use our services.

By using FitFights, you agree to the collection and use of information in accordance with this policy.

1. Information We Collect

We collect the following categories of personal information:

We do not collect precise GPS location, health or fitness metrics via Apple HealthKit or similar integrations, phone numbers, or payment information.

2. How We Use Your Information

We use the information we collect to:

• Operate and provide the FitFights service, including displaying your profile and battle videos to other users
• Send push notifications about battles, challenges, and app activity via Firebase Cloud Messaging (FCM)
• Ensure the safety of our platform through content moderation and enforcement of our Terms of Service
• Analyze app usage and crash reports to improve stability and performance
• Send beta invitations, product updates, and launch news when you join our early-access list
• Comply with legal obligations, including responding to lawful requests from authorities
• Communicate with you about your account or this Privacy Policy

3. How We Share Your Information

Public by design: Your display name, avatar, city, battle videos, and win/loss record are visible to other users of FitFights. When you participate in a battle, your performance is shared publicly within the app.

Service providers: We share data with trusted third-party providers that help us operate FitFights:

• Firebase (Google LLC) — Authentication, push notifications (FCM), and crash reporting
• Tigris / AWS S3 + CloudFront — Video and media storage and delivery
• Vercel — Web hosting and edge delivery
• Kit — Early-access email subscriptions and related email delivery

These providers process data on our behalf and are contractually bound to protect it.

Legal requirements: We may disclose your information if required by law, subpoena, court order, or government request, or to protect the rights, property, or safety of Kalio Studio, FitFights users, or the public.

Business transfers: If Kalio Studio, LLC is acquired, merged, or sells substantially all of its assets, your information may be transferred to the acquiring entity. We will notify you via push notification or in-app notice before your information is subject to a materially different privacy policy.

We do not sell your personal information. We do not sell, rent, or trade your personal information to third parties for their own marketing purposes.

4. User-Generated Content

When you upload battle videos or other content to FitFights, that content is visible to other users of the platform. You retain ownership of your content, but you grant us a license to host, display, and distribute it as described in our Terms of Service.

If your account is deleted, your videos are removed from our storage within 30 days. However, content that has already been shared publicly — such as finalized battle results — may remain visible to other users for a reasonable period during the deletion process.

5. Data Retention

We retain your personal information for as long as your account is active. If you delete your account:

• Your profile and account data are removed within 30 days
• Your uploaded videos are deleted from our storage within 30 days
• We may retain certain records longer if required by law, to resolve disputes, or to comply with DMCA takedown obligations

6. Your Privacy Rights

California Residents (CCPA/CPRA)

If you are a California resident, you have the following rights under the California Consumer Privacy Act:

• Right to Know: Request disclosure of the categories and specific pieces of personal information we have collected about you
• Right to Delete: Request deletion of your personal information, subject to certain exceptions
• Right to Correct: Request correction of inaccurate personal information
• Right to Opt-Out of Sale: We do not sell your personal information, so this right is not applicable
• Right to Non-Discrimination: We will not discriminate against you for exercising your CCPA rights

To exercise these rights, email privacy@fitfights.com with the subject line "California Privacy Request." We will respond within 30 days.

EU and UK Residents (GDPR / UK GDPR)

If you are located in the European Union or United Kingdom, you have the following rights:

• Right of Access: Request a copy of the personal data we hold about you
• Right to Erasure: Request deletion of your personal data ("right to be forgotten")
• Right to Rectification: Request correction of inaccurate personal data
• Right to Restriction: Request that we limit processing of your data in certain circumstances
• Right to Data Portability: Receive your personal data in a structured, machine-readable format
• Right to Object: Object to processing based on legitimate interests or for direct marketing

To exercise your GDPR rights, email privacy@fitfights.com. We will respond within one month.

You can withdraw consent for early-access and product-update emails at any time by using the unsubscribe link in any such email.

How to Exercise Your Rights

Email privacy@fitfights.com with a description of your request. We may need to verify your identity before processing your request. You will not be charged a fee to exercise your privacy rights.

7. Children's Privacy

FitFights is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If we become aware that a user is under 13, we will promptly delete their account and all associated data.

Users between the ages of 13 and 17 may use FitFights only with verifiable parental consent. By creating an account, users represent that they are 13 or older and, if between 13 and 17, that they have obtained parental consent.

If you believe your child under 13 has created a FitFights account, please contact us immediately at support@fitfights.com.

8. Advertising

FitFights does not currently serve advertising or share your data with advertising networks. In the future, we may introduce advertising or sponsored content. If we do, we will update this Privacy Policy and notify you via push notification or in-app notice before any such changes take effect.

9. Security

We use industry-standard security measures to protect your information, including HTTPS encryption for data in transit, Firebase security rules for authentication, and restricted access controls for stored media.

No system is completely secure. If you discover a potential security vulnerability in FitFights, please report it to support@fitfights.com so we can investigate and address it promptly.

10. International Data Transfers

FitFights is operated from the United States. If you are located in the European Union, United Kingdom, or other regions with data protection laws that differ from U.S. law, please note that your information may be transferred to and processed in the United States.

For transfers of personal data from the EU and UK to the United States, we rely on Standard Contractual Clauses (SCCs) as approved by the European Commission, supplemented by appropriate safeguards where required.

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. For material changes, we will notify you via push notification or in-app notice before the changes take effect. The "Last updated" date at the top of this page reflects when the policy was last revised.

Your continued use of FitFights after changes become effective constitutes your acceptance of the revised Privacy Policy.
